The Arizona Asian Chamber of Commerce (ACC) is the trusted hub for fostering economic growth, cultural celebration, and community connections within Arizona’s vibrant Asian American and Pacific Islander (AAPI) population. ACC provides the Arizona AAPI community with access to critical resources, mentorship, advocacy, and opportunities, driving sustainable success and amplifying the voices of our communities.

These Terms of Service ("Terms") govern your access to and use of the Arizona Asian Chamber mobile application ("App") and related services provided by the Arizona Asian Chamber of Commerce ("Arizona Asian Chamber," "ACC," "we," "our," or "us").

By downloading, accessing, creating an account for, or using the App, you agree to these Terms. If you do not agree to these Terms, you should not use the App.

1. About the Arizona Asian Chamber App

The Arizona Asian Chamber App is designed to connect members, businesses, professionals, community organizations, volunteers, event participants, and other members of the community.

The App may provide features including:

• Chamber membership services and member profiles
• Business and organization directories
• Community posts, comments, likes, and other social features
• Events, registrations, tickets, and check-ins
• Vendor preorders and order management
• Volunteer opportunities and assignments
• Badges, achievements, missions, rewards, and other engagement features
• Business, artist, professional, and community discovery
• Employment and community opportunities
• Chamber announcements and notifications
• Sponsor and partner content
• Social media and third-party content
• Other Chamber programs, resources, and services

Features may be added, modified, suspended, or discontinued at any time.

2. Eligibility

The App is intended for individuals 18 years of age or older.

By using the App, you represent that you are legally permitted to use the App and agree to these Terms.

Certain features may only be available to verified Arizona Asian Chamber members, businesses, staff, volunteers, event organizers, vendors, or other authorized users.

3. Accounts and Membership

Certain App features require an ACC membership or account.

You agree to provide accurate and current information when accessing or using your account.

You are responsible for maintaining the confidentiality of your account credentials, membership information, and access to your device.

You may not:

• Impersonate another person or organization
• Use another member's account or Membership ID without authorization
• Provide false or misleading account information
• Attempt to gain unauthorized access to another account
• Circumvent membership, administrative, or security controls

ACC may verify membership information and restrict access when information cannot be verified.

4. Community Features and User Content

The App may allow users to create profiles, submit posts, upload photographs, comment, react to content, list businesses, submit events, or otherwise provide content ("User Content").

You retain ownership of content you submit.

By submitting User Content to the App, you grant ACC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and use that content as reasonably necessary to operate, promote, and improve the App and ACC programs.

You are responsible for the content you submit.

You may not submit content that:

• Is unlawful, fraudulent, threatening, or abusive
• Harasses or targets another person
• Contains hate speech or discriminatory attacks
• Contains obscene or sexually explicit material
• Violates another person's intellectual property rights
• Violates another person's privacy
• Impersonates another individual, business, or organization
• Contains malicious software, spam, scams, or deceptive links
• Promotes illegal activity
• Intentionally provides materially false or misleading information
• Otherwise interferes with the safety or operation of the ACC community

ACC may moderate, restrict, hide, remove, or decline to publish User Content when reasonably necessary to enforce these Terms, protect users, or operate the App.

5. Public Information

Certain information submitted through the App may be publicly visible or visible to other App users.

This may include:

• Public member profiles
• Profile photographs
• Business and organization listings
• Community posts and comments
• Likes and reactions
• Badges and achievements
• Event participation
• Artist or professional profiles
• Other information that you intentionally choose to make public

You should not publish information that you do not want others to see.

6. Businesses, Organizations, Artists, and Directory Listings

The App may contain listings for businesses, organizations, artists, professionals, vendors, and other community resources.

ACC does not guarantee the accuracy, completeness, availability, quality, licensing, or reliability of every third-party listing.

Inclusion in the App does not necessarily constitute an endorsement by ACC unless explicitly stated.

Business owners and authorized representatives may be permitted to claim, create, or manage listings. ACC may require verification before granting control over a listing.

ACC may correct, restrict, merge, remove, or modify listings when reasonably necessary to maintain the accuracy and integrity of the directory.

7. Events, Tickets, Vendors, and Volunteers

The App may facilitate event registration, ticketing, vendor participation, volunteer assignments, check-ins, schedules, and other event activities.

Event schedules, locations, performers, vendors, activities, and other details may change.

Participation in an event may also be subject to additional event-specific rules, waivers, policies, or requirements.

Submission of an event, vendor application, volunteer application, talent application, or other request does not guarantee acceptance.

Tickets, registrations, reservations, or other event-related benefits may be subject to capacity limitations, availability, eligibility requirements, or additional conditions established for a particular event.

8. Preorders and Payment Obligations

The App may allow users to preorder food, merchandise, products, or other items from participating vendors.

Submitting a preorder through the App constitutes a commitment to purchase the items ordered.

Although ACC does not process or collect payment for these preorders through the App, you agree that you are responsible for paying the participating vendor the full amount due for your order in accordance with the vendor's accepted payment methods.

By submitting a preorder, you acknowledge and agree that:

• Your preorder is an order commitment and not merely a reservation or expression of interest.
• Payment is made directly to the participating vendor and not to ACC.
• You are responsible for paying the amount shown or otherwise communicated for your order.
• You are responsible for picking up or receiving your order according to the vendor's instructions.
• Participating vendors may prepare products, reserve inventory, purchase ingredients, or otherwise incur costs in reliance on your preorder.
• Failure to pick up or pay for a preorder may result in restrictions on your ability to use preorder features in the future.
• Any cancellation is subject to the participating vendor's policies and ability to cancel the order before preparation or fulfillment.
• Refunds, cancellations, substitutions, product issues, fulfillment issues, and payment disputes are generally between you and the participating vendor unless otherwise expressly stated.

ACC provides preorder functionality as a platform connecting users with participating vendors.

ACC is not the seller, merchant, or payment processor for vendor preorders and does not receive the payment owed to the vendor, unless expressly stated otherwise for a particular transaction.

Participating vendors are responsible for their products, pricing, availability, preparation, fulfillment, applicable taxes, payment collection, and compliance with applicable laws and regulations.

9. Badges, Missions, XP, Rewards, and Achievements

The App may include points, XP, badges, missions, achievements, rewards, rankings, or similar engagement features.

Unless expressly stated otherwise, these features:

• Have no cash value
• Cannot be exchanged for money
• Are not transferable between users
• Do not represent ownership or financial rights
• May be modified, corrected, revoked, or discontinued by ACC

ACC may correct points, rewards, badges, or achievements resulting from errors, misuse, fraud, duplicate activity, or technical problems.

Physical rewards, promotional items, event benefits, or limited-quantity merchandise may be subject to availability and additional conditions.

10. Social Media and Third-Party Content

The App may display, link to, import, or integrate content or services from third-party platforms, including social media services such as Instagram and TikTok.

Third-party content remains subject to the terms, policies, and rights of the applicable third-party service and content owner.

ACC does not claim ownership of third-party social media content solely because that content is displayed or linked within the App.

ACC does not control and is not responsible for the availability, security, accuracy, or practices of third-party services.

Selecting an external link may take you outside of the ACC App.

Your use of a third-party platform remains subject to that platform's own terms and privacy policies.

11. Sponsors and Promotional Content

The App may display sponsors, partners, promotions, featured businesses, or other promotional content.

The presence of sponsored or promotional content does not necessarily constitute an endorsement or guarantee by ACC of a third party's products or services.

Any transaction between you and a third party is between you and that third party unless ACC expressly states otherwise.

12. Location Services

Certain features may use your approximate or precise location, including business discovery, nearby services, event features, or check-ins.

Location access requires your device permission where applicable.

You may disable location access through your device settings, although some features may not function properly without it.

13. Notifications

The App may send push notifications regarding Chamber announcements, events, account activity, community activity, opportunities, missions, orders, volunteer activities, or other App services.

You may manage notification permissions through your device settings where available.

14. Acceptable Use

You agree not to:

• Attempt to interfere with or disrupt the App
• Circumvent security or access controls
• Attempt unauthorized access to ACC systems or data
• Use automated systems to improperly scrape or collect App information
• Introduce malicious software or harmful code
• Exploit bugs or technical vulnerabilities
• Manipulate votes, rewards, XP, badges, rankings, missions, or other App systems
• Submit fraudulent or intentionally false preorder requests
• Use the App to commit fraud or unlawful activity
• Use another person's personal information without authorization
• Abuse event, ticketing, vendor, volunteer, or community features

ACC may investigate suspected misuse and take reasonable action to protect the App, participating vendors, and its users.

15. Suspension and Termination

ACC may restrict, suspend, or terminate access to some or all App features when reasonably necessary because of:

• Violations of these Terms
• Fraud or suspected fraudulent activity
• Repeated failure to honor vendor preorder commitments
• Harassment or abusive conduct
• Security concerns
• Unauthorized account access
• Misuse of Chamber systems
• Legal requirements
• Conduct that materially threatens the App, ACC, participating vendors, or its community

Where appropriate, ACC may remove or restrict specific content or features instead of terminating an account.

16. Account Deletion

You may request deletion of your Arizona Asian Chamber App account and associated personal information by contacting:

• Full name
• Membership ID
• Email address associated with your account

ACC will process deletion requests in accordance with its Privacy Policy and applicable requirements.

Certain records may be retained when reasonably necessary for legal compliance, accounting, event administration, fraud prevention, security, dispute resolution, or other legitimate organizational purposes.

17. Intellectual Property

Except for User Content and third-party materials, the App and its associated content, branding, design, software, logos, graphics, and materials are owned by or licensed to ACC and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, sell, or commercially exploit ACC intellectual property without authorization.

18. App Availability and Changes

ACC works to provide reliable App services but does not guarantee that the App will always be available, uninterrupted, secure, or error-free.

The App may occasionally be unavailable because of maintenance, updates, technical failures, third-party services, or circumstances outside ACC's control.

ACC may update, modify, add, restrict, or discontinue features at any time.

19. Third-Party Services

The App may rely upon third-party technology and service providers, including cloud hosting, mapping, notification, social media, authentication, and other technology services.

These services may include, where applicable:

• Google Firebase
• Google Play Services
• Firebase Cloud Messaging
• Apple Push Notification Service
• Google Maps
• Instagram and Meta services
• TikTok services
• Other service providers used to operate App features

Third-party services maintain their own terms, privacy policies, availability standards, and operating requirements.

ACC is not responsible for interruptions or changes caused by third-party services outside ACC's reasonable control.

20. Disclaimer

The App and its content are provided on an "as is" and "as available" basis to the extent permitted by applicable law.

ACC does not guarantee that all information contained in community posts, business listings, event listings, vendor listings, external content, or other user-submitted material is accurate or complete.

Users are responsible for independently evaluating information before relying upon it.

ACC does not guarantee the products, services, availability, quality, safety, or performance of independent businesses or vendors appearing within the App.

21. Limitation of Liability

To the extent permitted by applicable law, ACC and its directors, officers, staff, contractors, volunteers, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to your use of or inability to use the App.

ACC is not responsible for losses arising solely from transactions between users and independent participating vendors, including vendor preorder transactions for which ACC does not process payment, except to the extent responsibility cannot legally be excluded.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

22. Privacy

Your use of the App is also governed by the Arizona Asian Chamber Mobile Application Privacy Policy:

The Privacy Policy explains how ACC collects, uses, stores, and shares information associated with the App.

23. Changes to These Terms

ACC may update these Terms periodically to reflect changes to the App, its services, legal requirements, technology, or organizational practices.

The most current version will be made available through the ACC website or App.

Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

24. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
